Elder Abuse and Nursing Home Abuse Differences

Although it may seem as if nursing home abuse is the same as elder abuse, they are, in fact, very different areas of the law.
nursing home abuse case is a civil action (lawsuit) against the nursing home and the staff of a managed care facility. These lawsuits arise when a resident of one of these facilities is injured as a result of the negligence of the institution. These lawsuits often result in both a change of behavior in the nursing home facility and a monetary award to the injured party or their estate.
Elder abuse, on the other hand, is a crime, in which an older person is abused by a private party—usually a relative, but it can be a care giver too.
